Cameroon's public procurement rules are set out in the Law No. 2017/013 of 12 July 2017 on Public Contracts and Public-Private Partnerships. The law provides a framework for the procurement of goods, works, and services by public entities, and aims to ensure transparency, fairness, and competition in public procurement processes.
In terms of bid collection methods, the law provides for two main procedures: open and restricted tendering. In open tendering, any interested party may submit a bid in response to a public notice that is widely advertised. In restricted tendering, only pre-selected suppliers are invited to submit bids.
The process for bid collection and evaluation includes the following steps:
Public notice: The public entity publishes a notice inviting bids in a national or international newspaper or on its website.
Pre-qualification: In restricted tendering, the public entity may first pre-qualify potential bidders by evaluating their technical and financial capabilities.
Bid submission: Bidders submit their proposals, which include technical and financial offers, as well as any supporting documents required by the public entity.
Bid opening: Bids are opened publicly in the presence of bidders or their representatives. The public entity evaluates the bids based on the predetermined evaluation criteria.
Contract award: The public entity awards the contract to the successful bidder, subject to any necessary approvals.
It's worth noting that the law also provides for the use of electronic procurement methods, which can simplify and streamline the bid collection process. However, specific guidelines for electronic procurement are not yet available in Cameroon.
